Tumaini: Laws Protecting Intersex Children and Persons in Kenya

This publication provides a source of HOPE and solace for intersex children and persons who have endured neglect, marginalization, stigmatization, ridicule, and a sense of being forgotten for an extended period. It acknowledges their enduring struggles while advocating for their comprehensive inclusion and equitable access to vital services over the course of many decades. Encouragingly, Kenya is emerging as a global trailblazer in safeguarding their inherent human dignity and protecting their fundamental rights. In the subsequent sections, we present a comprehensive review of the existing Kenyan laws, policies, and pending parliamentary bills that serve to safeguard and protect the welfare of intersex children and persons within the country. Report on the Status of the Intersex Persons in the Criminal Justice System in Kenya

The report reviews the legal framework in Kenya and the extent to which intersex persons are provided for within the criminal justice system. The report proposes legislative and institutional recommendations for enhancing the protection of intersex persons and ensuring all actors within the criminal justice system treat intersex persons with dignity. The Intersex Persons Implementation Coordination Committee (IPICC) was established by the Hon. Attorney General vide a Gazette Notice No. 7264 of 2019 dated 16th August, 2019; with the mandate to  assist the government in the implementation of the recommendations made in the Intersex Taskforce report, 2018.Pursuant to the Constitutional requirement to engage the people in the law making process, the Intersex Persons Implementation Coordination Committee (IPICC) through the Kenya National Commission on Human Rights, hereby invites members of the public to submit written comments on the draft Intersex Persons Bill, 2023.  The objective of the Bill is ‘to provide for the recognition, protection and safeguarding of intersex persons’ human rights in Kenya; to provide for the equalization of opportunities, affirmative action and non-discrimination of intersex persons, and for connected purposes. Download Here .

This booklet is a great resource to parents, teachers, all leaders, human rights defenders, health workers, children officers, CSOs, care givers of children, intersex persons and parents on many ways of protecting the intersex child, offer support, end stigma and discrimination and also avails reporting mechanism for further assistance. When an intersex child is born, with the current registration laws, such a child is given a wrong sex marker, and this culminates to a journey of mass human rights violations. This child begins to face societal stigma, some families view them as bad luck, some get killed, some face rejection, lack of proper parenting, vaccinations as well as education. The taskforce found that in instances- families’ break down and one parent is left to care for the child. Caregivers too go through mental anguish, and some get depressed and end up with mental health challenges. An intersex child is kept secret, some begin their journey of corrective surgeries and medical interventions that cost families livelihoods due to restrictive costs of appropriate medical testing/examinations. In Kenya, there are no medical protocols or care and treatment guidelines on how to manage an intersex child from birth to adulthood as well as NHIF or insurance packages for such. Read more
