KNCHR Alternative Report on Implementation of the Committee Against Torture (CAT)
In this 3rd periodic review report, the Kenya National Commission on Human Rights responded to a total of 35 human rights issues that relate to torture and other cruel, inhuman or degrading treatment. The Commission submitted the report on 22nd March 2022, and it was reviewed in May 2022. Some of the key issues presented to the Committee Against Torture include an update by the Commission on the tabling of the POTA bill 2024, which was awaiting adoption by parliament; a status update on the funding of KNCHR to especially facilitate implementation of the POTA Act; legislation of penalties for torture and ill treatment of children; prosecution for the offence of torture; and prosecutions on extrajudicial killings, enforced disappearances and excessive use of force, among others. PREVENTION OF TORTURE ACT, 2022
An Act of Parliament to give effect to Article 25(a) and 29(d) of the Constitution and to the principles of the Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment; to provide for the prevention, prohibition and punishment of acts of torture and cruel, inhuman or degrading treatment or punishment; reparations to victims of torture and cruel, inhuman or degrading treatment or punishment; and for connected purposes.
