Call to Uphold Human Rights and Adherence to the Rule of Law during 27th November 2025 By-Elections

The Kenya National Commission on Human Rights is deeply concerned by incidents of violence and intimidation reported in several regions during the campaign period for the Senatorial, Members of National Assembly and members of County Assemblies upcoming by- elections.

Notable are the tragic clashes in Kasipul Constituency, where two people lost their lives, violent disruptions of campaign rallies, alleged excessive use of force by police and presence of non- uniformed police in Mbeere North which is against a high court ruling. Such criminal acts violate the constitutional rights to life, security, peaceful assembly and participation in political processes.

The KNCHR condemns in the strongest terms all forms of political violence, intimidation, destruction of property and excessive use of force by any party or agency. These actionsseverely undermine the democratic process, public trust and social cohesion. The Commission calls on the relevant Agencies to immediately and transparently investigate the cases and hold the responsible to account as provided by the law.

The Commission calls on:
a) The Independent Electoral and Boundaries Commission (IEBC) to ensure the electoral process is managed fairly, transparently and without bias, guaranteeing security for voters and candidates.
b) The political parties and candidates to commit to peaceful elections, reject all forms of violence, hate speech, voter bribery and promote respect for the rights of all participants.
c) The law enforcement agencies to act impartially and adhere strictly to human rights standards, exercising restraint and avoiding excessive force while ensuring security.
d) The media to provide balanced and responsible reporting that fosters peace and discourages inflammatory rhetoric.

e) The community and general public to support peaceful processes and report any violations promptly.

In line with its constitutional and legal mandate, the KNCHR has deployed teams of Commissioners, staff and field monitors across the election zones. These teams will observe and monitor the election process and document failures in respecting human rights throughout the voting process, providing updates and a comprehensive final report. Everyone should enjoy the right to vote and be voted for freely without coercion bribery or intimidation.

The Kenya National Commission on Human Rights (KNCHR) calls on all stakeholders to uphold human rights, respect the rule of law and ensure a peaceful electoral process during the 24 by-elections across the country tomorrow, 27th November 2025. Free, fair and credible elections are the cornerstone of democracy, and the enjoyment of rights is dependent on the
adherence to constitutional and legal provisions.
