KNCHR Welcomes Establishment of the Office of Public Complaints |

The Kenya National Commission on Human Rights welcomes the establishment of the office of the Ombudsman in Kenya. The Commission recognizes that any good system of administration, in the final analysis, has to be responsible and responsive to the people. But history bears witness to the fact that more often than not, the impersonal bureaucratic system advertently or inadvertently tends to overwhelm the ordinary citizen. It is for this reason that there is need for an efficacious mechanism that can protect citizens from administrative faults. The establishment of the Ombudsman is a culmination of calls by various stakeholders and the public at large for creation of a “watchdog of the administration” and in pursuance of the Governments reform agenda in public service delivery. |

President should Convene National Stakeholders’ Forum on Escalating Insecurity |
|
|
|
The Kenya National Commission on Human Rights (KNCHR) wants President Mwai Kibaki to convene national stakeholders’ forum to discuss escalating insecurity in the country.The KNCHR is convinced such a forum will help generate the much needed information to enable the government draw a national policy framework on security, which the country currently lacks. KNCHR chairman Maina Kiai says the current strategy espoused the government of allowing the police to monopolize handling the country’ security has failed and new approaches are urgently needed. At the same time, Kiai has called upon media owners and the civil Society to team up with the KNCHR to establish a fund that will facilitate investigative journalists to unravel many of the ills that are facing Kenya. Such a fund, once establish will cover such things as the life and medical cover for journalists, facilitate sourcing and investigating sensitive, and address the personal safety issues thus fill the vacuum that current exists in that area. |

KNCHR Tribunal dismisses AG’s contention, sets date for case against Registrar of Societies |

|
The Kenya National Commission on Human Rights (KNCHR) Complaints Hearing Panel is set to continue with a case where the Registrar of Societies has been sued for violating the right to freedom of association contrary to Section 80 of the Constitution of Kenya by refusing to register a political party. Thrashing preliminary objections by the Attorney General, where the State had argued that the KNCHR panel lacked the requisite jurisdiction to entertain such proceedings, the KNCHR fixed 12th and 13th July 2007 for hearing the case noting that when Parliament set up the Commission, it clearly indicated that the State body had a certain mandate which included interrogating decisions made by public officials. |

KNCHR clinch the 2007 LSK Justice Cup |

|
Kenya National Commission on Human Rights (KNCHR) is the 2007 champions of the Law Society of Kenya (LSK) Justice Cup.
KNCHR beat Mahakama (Judiciary) Football Club 5- 3 in the post match penalty shout out, in the finals that were held at the Parklands Sports Club.
The 2007 LSK Justice Cup Tournament brought together over 40 teams drawn from the LSK, law firms, judiciary, media, auctioneers, law schools, the police, parliamentarians and human rights NGOs. The two teams ended into draw (0-0) before going for a penalty shoot out where the KNCHR won. The win by the National Commission ended a four year reign by Mahakama FC of holding the cup.

KNCHR to hold a Public Inquiry on National Security & Integration |

The Kenya National Commission on Human Rights (KNCHR) is set to hold a Public Inquiry on National Security & National Integration with sittings in Nairobi, Kiambu and Kisii. The inquiry to be held in September, 2007 will primarily focus on organized criminal groups. The National Commission will hold consultative meetings with various individuals, groups, organisations and government officials in various parts of the country.

The Kenya National Commission on Human Rights (KNCHR) has sent its position on the Statute Law (Miscellaneous amendment) Bill 2007 to the Government. The policy advisory contains a critique of the Bill that proposes the amendment of over 40 diverse Statutes.

The Kenya National Commission on Human Rights and the Ministry of Justice and Constitutional Affairs have initiated the process of developing a national policy and action plan (NAP) for the promotion and protection of human rights in Kenya. The NAP will be the country’s blueprint/ guiding document regarding human rights in Kenya. One of the key strategies in developing the NAP is through regional hearings, constitute the most important stage in the development of the NAP. |

The KNCHR to launch Position Paper on Abolition of the Death Penalty in Kenya |

The National Commission wants the urgent need for the abolition of the death penalty from the Kenyan Statutes because it is a violation of the fundamental right to life. In a Position Paper on Death Penalty to be launched on 18th April 2007, the National Commission hopes to open national debate on the merits of abolishing death penalty in Kenya. The view of the National Commission is that Kenya as a civilised society should not accept retributive justice whose essence is the eye-for-an-eye strategy because to support the death penalty is to teach that revenge is an acceptable way of dealing with crime.Under the Kenyan law, offences of murder, treason, robbery with violence, including attempted robbery with violence, carry a mandatory death sentence.The paper outlines the abolition of the death penalty in Kenya from a human rights perspective including the position of the Commission on the subject. |

KNCHR to Launch a Public Inquiry |

The Kenya National Commission on Human Rights KNCHR is scheduled to conduct a public inquiry into alleged violations of human rights by salt mining companies between 4th-8th July 2005 at Marereni sports-ground in Malindi. This is a landmark inquiry since it is the first ever to be conducted by a national human rights institution in Kenya. A panel of seven including four Commissioners from KNCHR, Ms Violet Mavisi, Vice Chair, Comm. Lawrence Mute, Comm. Fatuma Ibrahim and Comm. Godana Doyo will listen to evidence presented by both sides and make recommendations to the Government. Other panellists include Prof. Okoth Ogendo, a specialist in land matters, Mr. George Wamukoya, an environment expert and Mr. Mwachengu Mwachofi. |

Referendum Report |

The Kenya National Commission on Human Rights (KNCHR) and the Kenya Human Rights Commission(KHRC), a Non-Governmental Organization, launched joint report entitled,“BEHAVING BADLY: Deception, Chauvinism and Waste during the Referendum Campaigns.” This was an effort to by the two organisations to check against misuse of public resources and the use of inflammatory speech by politicians to mobilize for ethnic support among other human rights violations during the referendum campaigns in 2006. The Kenya National Commission on Human Rights (KNCHR) and the Kenya Land Alliance (KLA) published a report on land grabbing in the in the Country. “Unjust Enrichment: The Making of Land Grabbing Millionaires” highlights the cost and the human rights dimension in the illegal and irregular allocation of public land as revealed in the Commission of Inquiry into the Illegal/Irregular Allocation of Public Land.The report highlights the forests which were grabbed and other prime public land, the persons behind it, the beneficiaries and what Kenyans lost as well as consequences of this illegal irregular allocation. KNCHR Sues the Police |

The Kenya National Commission on Human Rights, KNCHR has sued the police for denying the Commission access to police cells in some police stations in the country. The Commission is mandated by its constituting Act, the Kenya National Commission on Human Rights Act 2002, to visit places of detention to inspect conditions under which in mates are held and make recommendations to the government. The Commission presented its case before the Nairobi Chief Magistrate Aggrey Muchelule through the Commission’s lawyer James Orengo. The Commission is also seeking for an interpretation of its Act in a constitutional court. |

Ratification of International Criminal Court is an Essential Pillar for Securing the Rights of Kenya |

The Kenya National Commission on Human Rights (KNCHR) yesterday commended the Cabinet for the principled position it took by approving ratification of the Statute of the International Criminal Court, (ICC), and by depositing the Ratification Instruments at the United Nations in New York. In statement read by the Commissioner Lawrence Mute at KNCHR boardroom, the Commissioners applauded the Government of Kenya for taking what they termed as a landmark step that required long and hard reflections before making the decision. |
