|
EXPERIENCES FROM UHURU PARK ON THE PROMULGATION DAY As was expected, on the day of the promulgation thousands of Kenyans thronged the famous Uhuru Park and braved the chilly morning weather to witness the birth of the second republic so to speak. Indeed that was a palpable and overwhelming feeling all across the grounds as Kenyans from all walks of life met there to perhaps re-write history. One could not help but appreciate the resilience of the people since it was not so long ago that we were fighting and killing each other, but now we have all embraced one another in not only endorsing the new draft constitution which has now become law but also in appreciating that when all has been said and done we are still one country and we should do everything to ensure its prosperous perpetuity. In retrospect it is a tragic case that history has given us another chance to make this country better since, by mutilation of the first draft we were condemned by the perpetrators into wasted years of abject poverty and human rights abuses. The institutional reforms that we all hope will be achieved must be strongly defended and we must not forget that we are not going to enjoy the fruits found therein the constitution without getting a monumental challenge from those who wish to hold on to the old dark days of repression. |

KNCHR nominated to the first NHRI Human Rights and Business Working Group (WG) |
|
The Kenya National Commission on Human Rights (KNCHR) has recently been nominated to represent the African region on the new Working Group on Business and Human Rights of the International Coordinating Committee of National Human Rights Institutions (ICC). The first meeting of the Working Group, comprising 8 members from the ICC’s four world regions, was held in Copenhagen on August 12-13, 2009, where the strategy and program of the Working Group was developed. Other countries nominated by their regions to this WG are National Commission for Human Rights, Togo (Africa Region), Jordan National Commission for Human Rights (Asia Pacific), National Human Rights Commission of Korea (Asia Pacific), Procuraduria para la Defensa de los Drechos Humanos de Nicaragua (PDDH) (Americas), Defensoria del Pueblo de Venezuela (Americas) the Danish Institute for Human Rights (Europe) and Scottish Human Rights Commission. KNCHR Position on formation of Special Tribunal for Post 2007 Election Violence |
The National Commission wants a local Special Tribunal to try the perpetrators of Post 2007 Election Violence, as opposed to the International Criminal Court (ICC). The Commission has also sent an advisory brief to parliament on proposed changes to the Constitutional (Amendment) Bill that will seek to establish an effective Tribunal in the Kenyan constitution. KNCHR has urged the Government to implement the International Convention on the Rights of Persons with Disabilities, ICRPD. Speaking during the Sixth General meeting of the African Union of the blind in Morocco, Commissioner Lawrence Mute urged African States to respect, protect and facilitate the rights of persons with disabilities through adoption of legislative, administrative and other measures for the implementation of the rights recognized in the Convention.
